Government officials as well as immigration lawyers have been implicated in several recent corruption cases. Yesterday I e-filed my EAD and AP renewal for me and my wife but I think I may have messed up a little.
1) I forgot to save the confirmation receipt( pdf) from me and now I cannot get it anywhere. I did it save it for my wife. I belive I need this along with the supporting documents. How Can I request the confirmation receipt from USCIS
2) I did not find any instructions come up for the list of supporting documents that need to be sent. Should I send the supporting documents (based on what I saw on this site) anyways?

You can email to E-Filing.Support@dhs.gov requesting the receipt notice in pdf format. I had the same situation and i emailed the above Id and got receipt notice (pdf) in 48hrs. BTW in the email give your receipt number.

You can apply for H1 transfer now.. but you'll more than likely get a RFE for paystubs.. and if you can provide them (and depending on your job, client letter etc.,) you are good.
If you old company cancels your h1, you are still good if you applied for transfer before that...
The only risk might be that you might get approval without I-94 if your old I-94 expired already, which is not true in your case I assume..
Btw, this is a public forum, you can expect responses, but no one is paid or obliged to do so... so URGENT responses should not be expected here... for such cases, you better pay for a lawyer.

In the past ten months, we have made tough choices, and implemented significant reforms within the current legal framework�but they are not enough to create the system that we want or that we need. If we are truly going to fix a broken system, Congress will have to act.When it comes to immigration, I took an oath as Secretary of Homeland Security to secure the nation by enforcing the law and managing legal flows across the border. Let me be clear: to do this job as effectively as possible, DHS needs immigration reform.Reform legislation would provide lasting and dedicated resources at our borders, and provide some critical legal tools that we don�t currently have to combat smuggling organizations. For example, we need tougher anti-smuggling laws in dealing with the aggravated crimes smugglers commit�including assaulting law enforcement officers, endangering children, threatening relatives and abandoning people in the desert� hundreds of whom succumb to death from heat and lack of water. We also need to update current laws that don�t cover some of the new means by which criminals conduct their business. Guys I am posting this under General Information knowing that this is definitely not an immigration related question. So, please control your urge for giving negative reps. I have booked a wheelchair for my mom who cannot walk properly in Frankfurt airport during her transit of flights. Do they generally take them till the next flight gate? Also, there is only one hour time gap between these 2 flights? Will this be sufficient for them to take her to the next flight gate. Has anyone used this service for your parents and what are their experiences?

We have applied for I -485 last month.I am the primary applicant and my spouse is add on.Bothe of us are on H1B and it is valid till end of 2008.
I have applied for EAD and advance parole for my spouse only.We have not yet received the receipt numbers .I was wondering if we want to travel outside the country do we need to wait untill we get any of the above or if we have a valid H1B can we travel outside the country.

If you'll have a valid visa stamped on your passport then you guys have no issue on traveling outside U.S. Please do carry your 485 receipt notice while traveling.
If you do not have a valid visa stamped then you should wait till get your AP and then travel on AP.

If you have a receipt as proof that an extension application was filed on your behalf before expiration of your H1 then you have 240 days starting from the day your visa expires before you should get an extension. You will be out of status if your case is not resolved in the 240 days deadline. I cannot comment on the implications of missing out on a deadline for responding to the RFE.

Remember its your responsibility to turn in I94s. No one is going to ask you these when you depart the US. Submitting the i94s and using the us visit system enable correct traclking of your entry/departures. Read the instructions on the 1797 it tells you clearly what you need to do.

As far as I recollect, the Murthy article was about the spouse(dependent) receiving a GC (as part of a derivative spousal application) when his/her spouse(primary beneficiary)'s PD or her PD was not yet current.
Primary beneficiary had not received the GC, but spouse received it in error. May be that's diff from the situation where the primary beneficiary himself/herself receives the GC while the PD is not current.

I am trying to use an existing labor from my company which has oct 2001 priority date. To date I have nine years experience and I have passed out in 1997.
I started working in Aug 1996 and continued my studies and finished it by mid 1997.
Labor cert is EB2 has requirement as master degree with 3 yrs exp or bachelors and 5 years exp.
If consider at the time of application experience then I meet all the job/tech area and experience (nearly 95%). My question is should by current experience be considered then I am over 9 years nearly 10 years exp.
What experience will be considered when labor cert is transfered? If it is my current experience because the labor is getting switched to me now or if it’s my experience at the time of the application was applied. How strict is INS to match each and every criterion in swapping a labor.
My other question is how strick is INS on the term mentioned in requirements. If the applicant transfering the labor matches in all aspects almost 100%, and in required experience one is short by one 3 months or less would INS still consider all other aspects and can OK it.

My 140 was recently transferred from Nebraska to Texas after waiting 13 months. RD is March 2007. My company's lawyer contacted USCIS to open an SR as Texas is processing July/Aug 2007 applications and past my processing dates. USCIS refused to open an SR and advised that my application will be treated a new one and will be processed after the other application received in April 2008.
I think USCIS should honor the original RD when a case is transferred from one service center to the other.
I am shocked. I have already waited for 13 months and don't feel this is fair.
I am not sure what are my options are now? I am thinking to contact Ombudsman and local congress man.
Please advice.
